Our Trademarks & Global Brand Management Practice Group offers comprehensive brand management services worldwide. We counsel clients on global brand rollout, global trademark portfolio management and worldwide enforcement, including both litigation and non-litigation measures. We manage the trademark portfolios of numerous public companies, large and sophisticated privately-held companies, global consumer goods companies, universities and nonprofit organizations across all business sectors.

Global Trademark Portfolio Strategy and Development

We have extensive experience advising clients as to the selection of trademarks both in the United States and overseas. Our group offers a range of search capabilities, the results of which can inform a trademark owner of potential conflicts so that informed decisions can be made at the outset. When clients decide to roll out a corporate rebranding, our team works together to coordinate company name reservations, domain name reservations and trademark filings. Regardless of the type of mark selected, we can protect it by registering the trademark, service mark, design mark or other nontraditional mark at the federal and state levels and around the world. We offer ongoing services, such as IP audits, to ensure that present day trademark filings cover our client’s current and future business objectives.

Through years of working with foreign counsel, our firm has honed a go-to list of foreign counsel who are fluent in English and with whom we coordinate to offer multi-jurisdictional, practical, cost-effective solutions. Through our network of international affiliates, we can obtain legal opinions in any jurisdiction of interest. Working together with our international counterparts, we are strategically positioned to address trademark issues both in the United States and around the world.

Trademark Policing and Enforcement

A mark, even if registered, can lose its distinctiveness if it is not properly and adequately enforced and infringement stopped. Our extensive monitoring services allow us to help clients find practical and cost-effective ways of monitoring the internet and international trademark registers for possibly confusing and infringing marks. As issues are uncovered, our group offers comprehensive enforcement advice, typically starting with non-litigation measures. Recognizing that litigation is both expensive and time consuming, we generally view litigation as a measure of last resort. Should litigation be necessary, we leverage our firm’s litigation group’s experience to provide comprehensive litigation services. As a result, we can represent clients in any forum and in any proceeding, including opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB) and can assert and defend claims of infringement both at home and around the world. Our group understands that each client’s situation is unique and will customize an enforcement strategy that meets the client’s legal and financial needs and risk tolerance.
