We represented Hopscotch Healthcare Inc., a primary care provider serving rural communities, in the case Hopscotch Corp. et al. v. Hopscotch Healthcare Inc. Hopscotch Corp, a provider of mental health services, filed a lawsuit against our client claiming its use of the “Hopscotch” trademark was causing confusion among consumers, employment candidates and other healthcare service providers. Our client denied these allegations as it had a license from a senior user of the HOPSCOTCH Mark and because it used the Mark on different services. Consequently, our client filed a counterclaim asserting it had superior rights in the HOPSCOTCH Mark. The case was settled pursuant to a confidential settlement agreement.
