Primary Care Providers Win Challenge of CMS Interpretation of Enhanced Payment Law

With the help and support of the Tennessee Medical Association, 21 Tennessee physicians of underserved communities joined together and retained Bass, Berry & Sims to file suit against the Centers for Medicare & Medicaid Services to stop improper collection efforts. Shannon focuses her practice on healthcare regulatory matters with a specific emphasis in the specialty pharmacy industry. She advises clients on regulatory matters arising in pharmaceutical trade and distribution, such as the Anti-Kickback Statute, the Health Insurance Portability and Accountability Act (HIPAA), the Civil Monetary Penalty Law, and FDA regulations such as the Drug Supply Chain Security Act. Additionally, she assists clients with the development, drafting and negotiation of agreements related to various components of the drug supply chain, such as limited distribution networks, pharmacy services agreements, and hub arrangements. Shannon also provides regulatory guidance on transactional issues.

  • Specialty Pharmacy – Assisting specialty pharmacies with program development, contracting strategy and negotiation, regulatory guidance and licensure issues
  • Drug Distribution – Providing legal and regulatory guidance related to the supply chain to specialty and retail pharmacies, pharmaceutical manufacturers, wholesale distribution centers, and hubs
  • Healthcare Contracting, Regulatory & Operational Matters – Providing counsel on healthcare operations, regulatory and reimbursement issues
  • Healthcare Transactions- Conducting healthcare regulatory diligence in pharmacy transactions in the specialty pharmacy industry
  • Healthcare Compliance & Administrative Proceedings – Developing and evaluating compliance programs for healthcare clients and defending clients in regulatory matters; responding to and appealing the results of payor claims audits
