Bass, Berry & Sims attorney Tatjana Paterno provided insight on the growth of deal insurance in M&A transactions, a key takeaway from the American Bar Association’s (ABA) 2019 Private Target Mergers & Acquisitions Deal Points Study for an article in The Deal. Tatjana served as Chair of the Study.

According to the Study, representations and warranties insurance was used in more than half of transactions, an increase of almost 30% from the previous study (2017). According to Tatjana, the increase demonstrates “the growing comfort that strategic acquirers have with this insurance product.”
