Bass, Berry & Sims attorney Steve Jasper provided insight for an article detailing the Supreme Court of Tennessee’s decision in Chartis Casualty Co. v. Tennessee. In this case, five Pennsylvania-based insurance companies questioned retaliatory tax assessments charged by the Tennessee Department of Revenue. Although the lower courts sided with Tennessee, the State Supreme Court reversed, holding “that because the burden of collecting and remitting Pennsylvania workers’ compensation assessments is on employers, and not on insurance companies, the Pennsylvania insurance companies are not liable for the additional Tennessee taxes.”
