Bass, Berry & Sims attorneys Mike Sontag, Steve Jasper, and Michael Cottone authored an article for State Tax Notes analyzing developing issues regarding Tennessee’s business tax, including:

  1. Whether sales of software are subject to the business tax.
  2. Whether the exemption for manufacturers is constitutional.
  3. How the classification of “mixed” businesses that sell both tangible personal property and services should be determined.

The authors anticipate that these issues will be significantly advanced during 2020, and the authors advise that, because of the fast-changing business tax landscape, “taxpayers should be on the lookout for new business tax developments in 2020 and beyond.”
