John GolwenTell us about your practice.

I focus my practice on business litigation. I represent a wide variety of businesses including healthcare, financial, retail, service, energy, construction and transportation companies. I also routinely represent business owners, management and members of corporate boards of directors. I chair the firm’s Business Disputes Practice Group and also serve as the Assistant Practice Group leader for Litigation. I have tried federal and state court lawsuits, and have also tried many arbitrations especially in the last ten years. I have also argued many cases in front of the appellate courts in Tennessee and in federal courts of appeals. For the last two years, I have served as a Rule 31 mediator and greatly enjoy mediating complex disputes.

What are some trends you are seeing related to the legal industry or in an industry in which you practice?

The biggest trend I see is in the world of litigation is the increased use of alternative dispute resolution. Most courts now require cases to be mediated or engage in a judicial settlement conference prior any trial date. I also am encountering more and more business contractual agreements to arbitrate commercial disputes. As the cost of litigation has greatly increased, I think these trends are a positive for our clients.

What is the most fulfilling part of your job?

I think the most fulfilling part of my job is getting to work alongside some really talented and smart lawyers at this firm. I have worked closely with not only my Memphis colleagues, but lawyers in every office of our firm. Over and over again I have positive experiences and have come to recognize what a special place we have here.
