We obtained a declination and dismissal of a False Claims (FCA) case filed against a physician-owned entity with interests in multiple ambulatory surgery centers. The investigation centered around allegations that the company was providing investment opportunities in the surgery centers in violation of the Anti-Kickback Statute, which resulted in false claims under the FCA. After several months of investigation, the government declined to intervene in the case, and following the government’s declination, the relator voluntarily dismissed the case.
