We represented a rural hospital in the Mountain West area from which a former nurse diverted over 1,000 hydrocodone and oxycodone tablets. When the nurse was criminally charged with felony possession and theft, she initially attempted to blame the hospital for enabling her conduct by improperly securing and handling the controlled substances. After producing documents identifying the hospital’s policies and controlled substances records to the government and nurse, the nurse accepted a plea agreement and no action was taken against the hospital.
