We represented a Turkish-based construction company in a qui tam FCA lawsuit involving a contract for work performed at Bagram Air Force Base in Afghanistan. While the government declined to intervene, the relator pressed forward with the litigation, alleging that our client violated the FCA by submitting false and inflated cost or pricing data in violation of the Truth in Negotiation Act (TINA). The parties ultimately participated in a mediation in front of the assigned magistrate judge, and the litigation settled with no adverse results to our client and exculpatory statements in the settlement agreement.
