We represented Erlanger Health System in False Claims Act litigation alleging improper billing to Medicare and Tennessee Medicaid related to overlapping surgeries and the performance of surgical procedures by trainees without appropriate physician supervision. Following a multi-year investigation, both the Department of Justice and the State of Tennessee declined to intervene. The court granted in part and denied in part our client’s motion to dismiss, and the matter was ultimately resolved while summary judgment was pending.
