We obtained a dismissal of a lawsuit accusing a national home improvement retailer of failing to properly address a female employee’s sexual harassment complaint. The district judge granted summary judgment in favor of our client on harassment, gender discrimination and retaliation claims made by the plaintiff under the Tennessee Human Rights Act, finding that the plaintiff could not prove the company allowed a hostile work environment or failed to take appropriate action. Additionally, the judge concluded that there was no evidence the company failed to take corrective action and that the company had actually instructed the perpetrator to stay away from the plaintiff, and fired him just three business days later, following an investigation into the matter.
