Dismissal of Case Against Government Contractor Based on Contractual Limitation Period

We represented a government contractor in litigation related to a contract for a field maintenance manual for a refrigerated container system. A subcontractor filed a lawsuit against our client in the Northern District of Ohio, seeking payments it claimed were owed under the subcontract. Our team successfully relied upon a one-year contractual limitation clause in the prime contract, which was flowed down in the plaintiff’s subcontract. The district court agreed with our team’s argument and dismissed the case.
