Bass, Berry & Sims represented Erlanger Health System, the nation’s seventh largest teaching hospital, in FCA allegations of improper billing to Medicare and Tennessee’s Medicaid program for overlapping surgeries and leaving trainees to complete operations without physician supervision. Following a multi-year investigation, Tennessee and DOJ declined to intervene in the lawsuit. The court granted in part and denied in part our client’s motion to dismiss. The matter was resolved while summary judgment was pending.
