Jason is the Managing Partner of the firm’s Chicago office and one of the founding members of the Bass, Berry & Sims Chicago office.
He represents Fortune 100 brands and technology disrupters, media companies, airlines, quick service restaurants, consumer packaged goods companies, and other advertisers in all aspects of the commercialization of products and services, advertising, marketing, AI, new media, branding, privacy, mobile marketing, behavioral advertising, right of publicity, and traditional trademark and copyright prosecution and counseling.
As a ranked attorney in WTR 1000 and Chambers USA in advertising & media, Jason has earned a national reputation counseling brands and leading consumer companies. His work involves:
- Advertising & Marketing Counseling – Reviewing advertising copy and advising with regard to claim substantiation, false advertising and related intellectual property and privacy/publicity issues, sweepstakes, contests, loyalty programs, and other consumer-facing programs and promotions.
- Talent, Influencer Marketing & Social Media – Reviewing and negotiating agreements with talent, macro- and micro-influencers; counseling on proper structure of brand policies and campaigns; and developing social media and influencer policies.
- Sports Law – Advising brands, NCAA Power 4 conferences and universities, and professional sports teams on all issues related to sports sponsorship, employment of coaches and staff, purchase and sales of teams, and all other related matters, including merchandising, marketing, branding, privacy, rights of publicity (NIL), and trademark and copyright matters. Jason’s sports sponsorship work has included negotiations with most professional sports organizations, including the NFL, NBA, MLB, NHL, MLS, the International Olympic Committee, U.S. Olympic & Paralympic Committee, U.S. Olympic & Paralympic Properties, and universities in the Big Ten Conference.
- Emerging Technology Counseling – Advising on artificial intelligence matters involving global, enterprise-wide solutions and their novel business and regulatory issues including contract legal management, contract intake, contract risk analysis, advertising/marketing clearance intake, decision risk analysis on review of advertising collateral, development of brand councils, consumer advertising review boards, and other cost-reduction vehicles.
- Media Buying & Selling – Counseling advertisers in the development of internal media and creative agencies and negotiating agency–client agreements, media buying agreements, and network clearance.
- IP & Brand Protection – Representing clients on trademark and copyright clearance and protection, music licensing, asset licensing and protection strategies, as well as trademark portfolio management and enforcement.
- Advertising, IP, & Publicity Disputes – Advising on complex advertising disputes and litigation, including federal, state and local false advertising, consumer disputes, regulatory investigations, NAD matters, copyright and trademark infringement, misappropriation of ideas, media and advertising disputes, and litigation and related contractual disputes.
Jason served on Law360’s Media & Entertainment Editorial Board and is adjunct faculty at Chicago-Kent College of Law.
He provides pro bono legal services through Lawyers for the Creative Arts, and he serves as a Trustee of the Children’s Research Fund, benefiting the Ann & Robert H. Lurie Children’s Hospital of Chicago.
