Bass, Berry & Sims attorney Tim Garrett was quoted in an article for McKnight’s Home Care discussing a recent decision from the U.S. Court of Appeals for the Sixth Circuit that supports the pending reinstatement of the companionship exemption.

The recent ruling suggests the Department of Labor (DOL) does indeed have the legal authority to interpret and adjust wage rules under the Fair Labor Standards Act.

The case is, “highlighting what I think is a tension right now with an aging population: How do we try to provide affordable quality care through people that are sufficiently compensated?” said Tim.
