Bass, Berry & Sims attorneys Terry Clark and Janelle Waack provided comment for an article in Modern Healthcare outlining the upcoming healthcare industry cases before the U.S. Supreme Court. The article speculates how these cases will be handled in light of Justice Scalia’s recent passing. Terry and Janelle commented on the consolidated cases of Halo Electronics Inc. v. Pulse Electronics Inc. and Stryker Corporation v. Zimmer, examining whether a medical device company is eligible to receive up to triple damages for patent infringement. As Terry and Janelle point out in the article, this consolidated case, “could have a big impact on patent law and influence how companies ensure they don’t get pegged for willful infringement on another company’s patent.”
