In a Bloomberg Law article, Bass, Berry & Sims attorney Danielle Sloane reacted to the announcement that Medicare will release a proposal to revise the physician self-referral law. The proposed rule will be released by Labor Day and will address concerns related to the administrative burdens under the Stark Law.
Healthcare providers are hopeful the upcoming proposed rule will create exceptions that encourage more collaboration among providers and allow financial incentives to be worked into value-based care models. Another hope is that the CMS either expands the Stark law’s electronic health record safe harbor or creates a new safe harbor to let health-care facilities share cybersecurity software with physician practices, Danielle told Bloomberg.
