Bass, Berry & Sims attorneys John Kelly and Danielle Sloane provided insight for two separate articles in the January 2016 issue of G2 Compliance Advisor, a monthly publication targeting issues associated with clinical labs and diagnostics practices. In the article, “Four Fraud and Abuse Enforcement Trends That Labs Should Be Aware Of,” John cautioned, “‘[e]nforcement is increasing. Efforts in health care fraud and abuse are picking up.'”

Danielle provided commentary for several of the tips included in the article, “Top 10 Compliance Issues and Tips for 2016.” According to the article, the top compliance issue facing labs this year will be medical necessity. As Danielle explains, “‘[l]aboratories are going to increasingly have to justify the medical necessity of their tests, particularly testing that is done with any frequency … laboratories may consider requesting submission of supporting medical records along with the test requisition to ensure the medical necessity support is there on the front end.'”
