Bass, Berry & Sims attorney Danielle Sloane provided insights on the implementation of the No Surprises Act specifically in emergency departments (ED) for an article published by Relias Media. The No Surprises Act took effect January 1, 2022, and provides federal protection for patients from unexpected billing when using out-of-network emergency care.

“[T]here is a lot of confusion related to the implementation of the No Surprises Act. Both the statute and regulations are incredibly complex, and there are more unanswered questions than answers at this point,” says Danielle. Amid the confusion, one thing Danielle recommended for EDs is “In the short term, ED practices should update their website to include a surprise billing disclosure.”
