Bass, Berry & Sims attorney Audrey Anderson provided insight on the delay of the Department of Education’s adoption of new Title IX rules for higher education institutions. The new rules will dictate how facilities investigate sexual violence and accommodate transgender athletes. Despite originally proposed deadline of May 2023, the Department is delaying release of the final rules until October 2023 with an expected implementation for the 2024-2025 academic year.

As Audrey pointed out, this new timeline will allow colleges time to digest new complex regulatory requirements but avoid having them take effect during an academic year. A mid-year implementation would be problematic and “really poor policy,” said Audrey.
