Bass, Berry & Sims attorney Amy Sanders Morgan provided insight for a Law360 article that outlined the Drug Enforcement Agency’s (DEA) extension of the telehealth prescription rule. This is the second time the DEA has extended the rule that was established during the COVID-19 public health emergency and permitted healthcare providers to prescribe drugs without physically seeing a patient first. The rule was set to expire November 11, 2023. The new deadline is extended until December 31, 2024.
“I think for many providers, this offers some relief,” said Amy. “Uncertainty is never an ideal thing to grapple with, and knowing that we don’t have a deadline coming up in a little over a month, there’s definitely some relief there.”
