Bass, Berry & Sims attorney Emily Burrows was featured in Authority Magazine’s Q&A series to discuss her insights on cybersecurity compliance in the age of artificial intelligence (AI).

During the interview, Emily provided insight into the regulation of AI through laws and frameworks aimed at mitigating risks associated with AI. She also highlighted internal AI governance processes as a key consideration for organizations looking to employ AI and align with compliance standards and guidelines.

“Organizations should map what AI is currently being used internally, for what purpose it is being used, and what data is being processed through the AI tool,” Emily said. “They should also implement impact assessments in the procurement process to ensure that the risks from particular use cases are thought through and mitigation strategies are documented.”

When asked about specific compliance challenges, Emily suggested that data privacy is often a challenge when faced with malicious AI threats. She advised organizations to develop data privacy programs, saying “A compliant privacy program may not be able to fully prevent every security incident, but an organization will be in a much better place to, first, discover and remediate the incident and, second, defend itself against claims resulting from the security incident.”

Emily laid out several essential elements for companies to protect themselves from AI-powered cyberattacks, including governance programs, vendor management, the use of AI to stop AI, complying with privacy laws, and training.

“I would just encourage people to not forget that as AI becomes more commonplace and more lucrative, we have a responsibility as experts in the field to do our best to shepherd the use of AI in a safe, productive and beneficial way,” remarked Emily
