Bass, Berry & Sims attorney Julia Tamulis discussed what she was listening for during arguments in the case before the Supreme Court challenging the constitutionality of the Affordable Care Act (ACA). The Court heard arguments after a lower court invalidated the individual mandate as unconstitutional and left the status of the ACA in question.
As Julia told the reporter for the Inside Health Policy article, she is focused on the severability argument. “She will be listening for questions from Justice John Roberts, particularly considering his recent reliance on the severability doctrine in Seila Law v. Consumer Financial Protection Bureau, in which he said the doctrine should be used ‘as a scalpel rather than a bulldozer.'”
