Bass, Berry & Sims attorney Amy Sanders Morgan was interviewed for a story about the multistate lawsuit challenging the Affordable Care Act (ACA) that was broadcast on NPR’s Morning Edition on September 4, 2018. Twenty states have joined the lawsuit, arguing that the ACA is unconstitutional in the wake of the effective removal of the individual mandate. The Trump Administration has declined to defend the law, but several states and D.C., led by the California attorney general, have stepped in to defend the ACA.
Comparing this new legal battle with King v. Burwell, a previous challenge brought against the ACA, Amy stated, “That kind of started out as a very small case that no one really took all that seriously. And it made its way all the way up to the Supreme Court and became a formidable challenge.”
