Bass, Berry & Sims served as lead counsel to Hospice of Chattanooga Holdings LLC and Hearth Hospice, part of Care Hospice’s national network of hospice providers, and Gentiva, in a successful Certificate of Need (CON) opposition project. The project sought to establish a Chattanooga-based hospice to serve a five-county service area in Southeast Tennessee, including Bradley, Hamilton, Marion, Polk and Sequatchie Counties. The project was among the first considered by the new 15-member Tennessee Health Facilities Commission, which, effective July 1, 2024, will oversee both CON and healthcare facility licensure matters in Tennessee.
Hospice of Chattanooga serves over 3,500 patients across 10 Tennessee counties offering hospice and palliative care along with caregiver and grief support services. Founded in 2012, Hearth Hospice serves patients in Southeast Tennessee, Northwest and Southeast Georgia from seven offices. Gentiva operates in 38 states with nearly 600 locations and over 34,000 associates offering hospice and palliative care, home health care and advanced illness management.
