We represented a retailer in a series of investigations initially stemming from claims of sexual misconduct and harassment brought against an employee. Following an internal investigation, we assisted in counseling the client on the appropriate disciplinary action and other remedial measures to address the findings of the investigation. Subsequently, one of the complaining former employees brought an EEOC charge against our client, and we counseled the client throughout the course of the EEOC’s investigation, advising on a response strategy (particularly sensitive in light of potential reputational risk), and ultimately achieved a favorable settlement of the matter.
