We represented a publicly traded managed care company in a Department of Labor (DOL) audit of the potential misclassification of various employees as exempt under the Fair Labor Standards Act and of other individuals as independent contractors in its Texas market. We represented the company throughout the course of the audit and assisted the company with an ongoing self-audit regarding the same issues in other markets. We successfully argued the company’s position with respect to significant classification issues, negotiated back-pay issues with respect to other positions, and were able to report to the DOL the voluntary resolution of similar issues in other markets.
