We won summary judgment in an FMLA Interference case for our client, a home improvement retailer. A former employee claimed that his mistreatment and later termination were unlawful under the ADA and FMLA. We prevailed on summary judgment when the Court held that the transfer to a lower paying job which the employee claimed as mistreatment was actually an accommodation that he accepted, given his medical issues.
