Bass, Berry & Sims served as lead counsel to Optum Infusion Services 305 (Optum) in obtaining two Certificate of Need (CON) modifications to expand the scope of home infusion services delivered in its East and West Tennessee regions from IVIG-only to all infusion medications dispensed by Optum pharmacies. These CON condition modification requests were unanimously approved by state regulators. Bass, Berry & Sims previously represented Optum (formerly known as BriovaRx Infusion Services and AxelaCare Health Solutions) in obtaining statewide approval to establish a home health organization limited to IVIG infusions.
