We have advised St. Jude (and several other clients) on all aspects of Affordable Care Act compliance with respect to their employer-sponsored health plans. We have provided advice on plan design changes and amendments needed to comply with ACA’s insurance market reforms and reporting and disclosure requirements. In addition, we have partnered with the clients to develop a strategy for ACA’s employer shared responsibility rules, including how to design eligibility criteria to minimize risk and cost and how to track hours to determine full-time employee status. Finally, we have assisted the clients in designing and documenting their wellness programs in compliance with ACA’s changes to HIPAA’s nondiscrimination rules.
