We represented a full-service general contractor and its founders in a suit brought against them by their former employer that alleged a breach of their restrictive covenant agreements. Following expedited and extensive discovery, we filed a motion to dismiss based on the unlawfully broad restrictive covenants and the plaintiff filed a motion for a preliminary injunction. After oral argument on the motions, the magistrate issued a final report recommending that the motion to dismiss the lawsuit be granted, siding with our arguments that the agreements were unlawfully overbroad and therefore, unenforceable.
