Rob Newman advises global consumer brands, technology innovators, content creators, and publishers on legal matters at the intersection of privacy, marketing, and intellectual property. He provides his clients with practical, business-oriented counsel on privacy and marketing regulatory compliance matters; the protection and commercialization of their creative assets; and litigation risk avoidance in connection with data privacy, e-commerce, intellectual property, and emerging technologies. Rob is a founding member of the firm’s Chicago office.

- Privacy & Data Security – Advising clients on the privacy implications associated with new technologies; negotiating transactions involving significant data assets; defending clients in privacy and data-related disputes and regulatory inquiries; assisting clients in the assessment and development of data privacy and security programs; providing regulatory and compliance counseling with respect to data-driven marketing practices, adtech, content aggregation, artificial intelligence, consumer rights, privacy by design, data security, biometrics, telemarketing, children’s data, mobile marketing, digital media, and cross-border data matters.
- Artificial Intelligence (AI) – Assisting clients in the development of AI governance programs; negotiating critical agreements for developers and deployers of AI; advising on privacy and intellectual property compliance matters in connection with generative AI.
- Advertising, Marketing & Media – Advertising counseling and clearance for traditional and interactive advertising campaigns; negotiating creative services, advertising technology, and media buy agreements; counseling on consumer protection issues, e-commerce compliance, the design and implementation of promotions, and new media matters, including text message marketing, user-generated content, and social media.
- Technology Transactions – Counseling with respect to the negotiation of technology and data-driven transactions; negotiating software, hardware, media, cloud/SaaS, outsourcing, service, procurement, and distribution agreements.
- Global IP Management & IP Disputes – Counseling on brand strategy development, including trademark selection and portfolio management; advising on IP risk mitigation strategies; handling false advertising, copyright, trademark, domain name, defamation, right of publicity, and unfair competition disputes and litigation, as well as UDRP proceedings and matters before the National Advertising Division and the Trademark Trial and Appeal Board.
Prior to rejoining Bass, Berry & Sims, where he began his career as an associate, Rob previously served as Global Chair of the Emerging Technologies Practice at Reed Smith LLP, leading a group of more than 200 lawyers. Outside of his practice, Rob serves as an adjunct faculty member at the University of Illinois Chicago.
