Because the federal 340B law is silent on contract pharmacies, more states are stepping in to explicitly forbid drugmakers from restricting 340B drug deliveries to contract pharmacies.
Jeff notes, “The D.C. Circuit recognized that the 340[B] statute does not address the delivery of 340B drugs to contract pharmacies, and therefore that is something that can be regulated by the states.”
