Privacy Perils: Are Emoticons Discoverable Content?

As a follow-up to an earlier Privacy Peril entry on social media, recently some courts have held that, in addition to the actual word content of a message or post, accompanying “emoticons” or other text message expression symbols themselves are discoverable. That’s just one more way that an imprudent email, text message or social media posting can come back to haunt you.
