Bass, Berry & Sims attorney Jeff Davis provided comments for a Law360 article examining the future of the 340B Rebate Pilot Program following the injunction issued by a federal court late last year preventing the program from starting as planned on January 1, 2026.

When asked about the possibility of implementing a different type of rebate pilot program, Jeff said we would likely again see pushback and opposition from providers as several other factors – increased uninsured rates, upcoming Medicaid cuts and other pending legislation – are already impacting financial viability within the healthcare industry.

“You’re going to have this financial squeeze on providers more generally, and now the impact of the 340B rebates on top of that,” Jeff said. “So [there’s] a lot going on outside of the pilot program that also adds to the concern from the provider perspective.”
