Bass, Berry & Sims attorney Amy Sanders provided insight for various media related to the June 25, 2015 decision by the Supreme Court of the United States in King v. Burwell. In its decision, the Supreme Court ruled that tax credits can continue to be distributed through all health insurance exchanges, regardless of whether the marketplace was established by a state or the federal government. Significantly, the Court’s ruling prevents a future administration from changing that result through regulation. As Amy points out in one article, “[t]he certainty afforded by the King v. Burwell decision is, arguably, its most important feature. As the issue worked its way through the courts, unanswered questions slowed health reform momentum.”
