We successfully represented a dialysis supply company in False Claims Act (FCA) litigation concerning allegations of billing for dialysis supplies. The opinion by the United States Court of Appeals for the Sixth Circuit reserved the district court’s entry of summary judgment and entered summary judgment on behalf of our client and is a key FCA opinion on the issues of falsity, knowledge and materiality. Renal Care Group, Inc. (formerly NYSE: RCI) was a dialysis service provider that was acquired by Fresenius Medical Care AG (NYSE: FMS, FMS-p) in May 2005.
