We represented a multistate hospital ownership company and two of its hospitals in False Claims Act litigation alleging that inpatient admissions for certain surgical procedures were not medically necessary. The district court granted our motion to dismiss, finding that the relator failed to satisfy Rule 9(b)’s pleading requirements and failed to adequately plead materiality.
