Bass, Berry & Sims represented a hospital ownership company in connection with litigation of alleged FCA claims asserted by qui tam relators based on alleged violations of the Anti-Kickback Statute (AKS). The U.S. District Court for the Middle District of Tennessee granted our clients’ motion to dismiss, concluding that the relators’ complaint failed to allege remuneration and “but-for” causation sufficient to show a violation of the AKS.
