Pennsylvania Surgery Center Challenges Highmark for Improper Recoupment and Offset Activities

We served as lead counsel for a Pennsylvania surgery center in state court suit against Highmark for seeking to impose a new non-negotiated payment methodology with a “facility bulletin,” and then seeking to impose unauthorized recoupments and offsets. After the suit was filed and a motion for a restraining order was threatened, Highmark proposed mediation which led to a settlement on favorable terms.
