We represented U.S. Medical Management LLC in securing dismissal with prejudice of a False Claims Act lawsuit alleging that the company billed Medicare for medically unnecessary physician visits. The court held that the relator failed to plead fraud with the particularity required under the False Claims Act and dismissed the retaliation claim after finding no plausible allegation that the relator engaged in protected activity under the statute.
