Bass, Berry & Sims represented BryMak & Associates Inc. in successfully defending a $22.3 million U.S. Army lodging and transportation services contract award for the National Guard Professional Education Center in Little Rock, Arkansas. In its decision, the U.S. Government Accountability Office (GAO) denied incumbent contractor SRM Group’s protest, which claimed the Army unreasonably evaluated its past performance and, based on these alleged errors, made an unreasonable best value tradeoff. GAO found that the Army reasonably took a holistic view of BryMak’s—and its subcontractor’s—relevant past performance and concluded that BryMak offered the best value to the government.
