Bass, Berry & Sims member Denise Barnes will serve as a panelist at the 2026 White Collar Crime Institute on the session “Ethical Considerations in False Claims Act Cases for Relator, Defense, and Government Counsel”. The conference, hosted by the American Bar Association’s Criminal Justice Section, will take place March 10–13, 2026, at the Marriott Marquis San Diego Marina in San Diego, CA. Denise’s panel is scheduled for March 12, 2026.

Ethical challenges frequently arise in False Claims Act investigations, litigation, and trial. This session will examine issues such as how defense counsel navigates representing both a company and an individual, the responsibilities of relator’s counsel in gathering evidence, and best practices when communicating with parties represented by a company’s in-house counsel. Government attorneys face their own set of ethical obligations, and panelists will share practical strategies and insights for managing these complex situations effectively.

The session will be moderated by Habib Ilahi (Fluet, Tysons, VA) and will include panelists Jacklyn DeMar (The Anti‑Fraud Coalition, Washington, DC) and Jennifer Gregory (California Department of Justice, Sacramento, CA).
