Bass, Berry & Sims attorney Todd Overman outlined the case involving copyright infringement claims brought by a software development company against the United States Navy. In this case – Bitmanagement Software GMBH vs. The United States – the software company asserted that the U.S. Navy had infringed on the company’s copyrighted software by deploying the software in a “floating licensing system” that allowed for broad implementation of the software vs. the typical PC licensed-basis. The court found the United States was not liable for copyright infringement. As Todd points out, “The case highlights the importance of contract management and IP protection discipline when interacting with the government.”
