Bass, Berry & Sims attorney Anna Grizzle provided insight on a June 21, 2018, request from Centers for Medicare & Medicaid Services (CMS) for public comments on reducing Stark Law’s regulatory burden. Critics of the Stark Law, implemented in 1990, have long claimed the regulations imposed under the law prohibit the development and use innovative reimbursement models. Anna pointed out that several other Stark Law provisions have created barriers for providers looking to implement innovative payment models and move away from fee-for-service payments. Anna noted, “This request for comment is an acknowledgment by CMS that changes are needed to fully accomplish its intent to pay based on quality.”
