We represented a multi-state hospital ownership company in a multi-year Department of Justice (DOJ) investigation involving hospitals located in Texas, Arizona, Utah and Florida, and in related False Claims Act (FCA) litigation regarding alleged violations of the Stark Law and Anti-Kickback Statute and allegations regarding medically unnecessary services. This case resulted in declination by DOJ, dismissal following a motion to dismiss, and sanctioning of relator’s counsel stemming from misuse of privileged documents. Reported cases: U.S. ex rel.
