Bass, Berry & Sims attorney Michael Dagley provided insight on the reasons general counsel should consider taking the offensive approach as “corporate plaintiffs,” as it can likely lead to lucrative outcomes. “[In-house] lawyers don’t think of themselves as a potential profit center; they think of themselves as only a cost center,” says Michael. In order to change this mindset, general counsel must acquire the skill set of a plaintiff’s attorney. “I would identify a lawyer or team that has this plaintiff orientation; [one] who understands accounting, how corporations work, corporate governance, the boardroom, shareholders, all of that,” explains Michael.
