In 2003, U.S. District Judge Shira A. Scheindlin issued the seminal decisions on electronic discovery and data preservation in Zubulake v. UBS Warburg. A few years later, in 2006, the U.S. Supreme Court adopted amendments to the Federal Rules of Civil Procedure to reference “electronically stored information” or ESI. Since then, technology and data storage have continued to evolve. Businesses can now store exponentially more data at a small fraction of the cost, and many companies allow employees to use personal devices for business purposes. The rules and case law likewise continue to evolve alongside the technological advances, and this webinar will explore three key issues in electronic discovery in 2025.
