Bass, Berry & Sims attorney Dale Grimes will present at the 2016 Antitrust in Healthcare Conference. Dale will speak on the topic of “Provider Affiliations Short of Merger” on May 12 from 4:00 p.m. to 5:00 p.m. The session will discuss the emergence of healthcare provider affiliations and how they require antitrust analysis under Sherman Section 1 and Clayton Section 7. Topics will include:

  • Joint Ventures – What are they, and how do they fare under Section 1 and Section 7 analysis
  • Accountable Care Organizations (ACO’s) – What counseling challenges are posed by the explosion of commercial ACO’s to enable joint contracting?
  • Clinical integration programs – What risks do they pose when adopted without understanding the requirements necessary to comply with existing agency guidance?
  • Consumer-driven non-traditional alliances – Will these arrangements require counsel to rethink previous advice, and will the existing agency guidance be relevant?

The conference will be held May 12 – 13, 2016 at The Ritz-Carlton, Pentagon City in Arlington, VA. This biannual event is jointly sponsored by the American Bar Association (ABA) Health Law Section, ABA Section of Antitrust Law and the American Health Lawyers Association (AHLA).
